Service Conditions

When registering to use Quodari the user accepts the service conditions mentioned below. The user agrees not to store, share or publish any content using the Quodari app that is in breach of the law of the Netherlands.

Use of Quodari

Service conditions version 1.0

The user of Quodari is not permitted to store, share or publish any information using the Quodari app in breach of the law of the Netherlands. This includes specifically, but not exclusively, publishing information without the approval of the holders of copyright, information that is defamatory,  threatening, abusive, harassing, wrongful, offensive, racist, hateful, or discriminating, information containing child pornography and information that infringes the privacy of others or could lead to any form of stalking; this includes hyperlinks, torrents or other references to such information on sites of third parties anywhere in the world (even if the information would be permitted under local law).

Use in breach of Dutch law 

Quodari has installed a complaint procedure. Users (hereinafter called notifiers) can make a complaint if they witness content or behaviour that is potentially in breach of Dutch law. If Quodari considers the complaint to be justified, Quodari is entitled to block access to the related content and, if necessary, to the user account. Furthermore, in those cases Quodari is entitled to disclose information regarding the infringements to the relevant authorities. In such cases, Quodari will inform the notifier and user about the procedure. The personal data of the notifier will not be disclosed to the user in question or to the authorities.

In the case of criminal offence, Quodari is authorised to make a report to the police. In such a case, Quodari is allowed to disclose information to the relevant authorities about the user and the content concerned. If requested by those authorities, Quodari will support the investigations.

Liability

Quodari is not liable for any damage caused to the user by any action taken by Quodari in the context of the complaint procedure, even if the complaint proved groundless and the content was not in breach of Dutch law. If the complaint was proved groundless, Quodari will unblock any content and account(s) that might have been blocked in the context of the complaint procedure.

Actions causing damage

The Quodari user must not cause damage to other users,  the Quodari app, the website or the servers. The user is not permitted to start processes or programs if the user ought reasonably to have known of suspected that this could cause damage to Quodari or other users. 

The user is forbidden to try to get access in an illicit manner to the account or the data or content of other users or the service of Quodari.

In the event that the user performs acts that could damage Quodari or the other users, Quodari may take appropriate steps such as blocking the user's account. In the case of criminal offence, Quodari is authorised to make a report to the police.

If you would like to contribute to the safety and security of our platform as an ethical hacker, please contact us. Efforts to access user data or to get illicit access in any way without upfront written agreement will lead to measures including reporting the case to the police.

Limitation of use

Depending on the type of subscription, restrictions may apply to the available storage space for data and content, the volume of data-traffic and the functionality of the app. When the available storage or data traffic is exceeded, the use of the Quodari app may be limited. This could mean that the user will not be able to create and store new memos, photos or videos until the user has freed-up space or has paid for additional storage, data-traffic or functionality. 

Quodari will never be liable for the consequences of the user not being able to send, receive, store or change data or content when the limit for storage or data-traffic is reached.

Permission for storage and processing

The user allows Quodari to store all information which has been provided by the user via the Quodari app, and to process it where necessary.

Damage

Apart from the legal obligations, damage caused by incompetence or the failure to act in accordance with the points mentioned above,is for the expense of the user.

Complaint procedure

Users (hereinafter called notifiers) can make a complaint if they witness content or behaviour that is potentially in breach of Dutch law.

Complaints may be made by the notifier via the contact form.  If the complaint is about content, the notifier should take screenshots or photos of it as proof. These screenshots or photos should not be attached to the contact form, but submitted via a special link that Quodari will provide to the notifier after receipt of the complaint. The personal data of the notifier will not be disclosed to the user in question or to the authorities. The notifier will be informed by Quodari about the steps Quodari will take based on the complaint.

 

Quodari may not be used for purposes which are in breach of the law. Every user can report a suspicion of abuse via the complaint procedure.
